Please read this agreement carefully before accessing or using the information and services available through FindMe. By participating in this pilot program the employer and candidate agree to be bound by the terms and conditions below.
Information for personal, non-commercial use only
The employer and candidate agrees that information contained on FindMe is for use only for the purposes set out in this agreement, and may not be sold, redistributed or used for any commercial purpose (this includes but is not limited to the use of candidate contact details for unsolicited commercial correspondence).
The employer and candidate may not modify, copy, reproduce, republish, upload, post, transmit or distribute in any way any material from FindMe including code and software. The employer and candidate must not use FindMe for any purpose that is unlawful or prohibited by these terms of use.
Information does not represent professional advice
FindMe does not endorse or recommend any of the candidates on FindMe. It is the employers responsibility to assess the usefulness of the information presented, videos and communications through FindMe.
In no event will FindMe be liable for any decision made or action taken by the employer, in reliance upon any information contained on or omitted from the FindMe.
No guarantees Candidate Commitment
FindMe gives no guarantee to the employer of the continued availability of any particular candidate on the FindMe portal, and will not be liable to the employer, should an candidate have found another position, or is not available prior to removal of the job profile from the FindMe portal.
Whilst FindMe takes efforts to ensure that the employer and candidate are current, FindMe cannot take responsibility if the employer or candidate has decided to close, inactivate or change their requirements in their profile.
No guarantees as to the service
FindMe provides no warranty to the employer and candidate that the services generally available through FindMe will be uninterrupted or error-free, or that defects in the service will be corrected. The employer and candidate also understand that FindMe cannot and does not guarantee or warrant to you, that files available for downloading through the site or delivered via electronic mail through the site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties.
Efforts have been made by the FindME team to ensure that data and the platform is kept clear of viruses, threats and harmful elements that will damage the reputation of FindMe.
Guarantees as to security of information
While FindMe takes all due care in ensuring the privacy and integrity of the information you provide, the possibility exists that this information could be unlawfully observed by a third party while in transit over the Internet or while stored on FindMe systems or hosting service (Digital Pacific).
FindMe hosts data on Australian service, through Digital Pacific (201 Elizabeth St, Sydney NSW 2000). Digital Pacific is an Australian provider of quality web hosting solutions for individuals, small to medium-sized businesses and corporations.
FindMe will ensure that no data retrieved through the pilot program, pertaining to employer or candidate information will be sent, or stored outside of Australia. Information may be retrieved by our development team in order to address bugs, outages or errors within the platform.
Your password and login
To become a registered user, the employer and candidate must provide an email address, and password. The employer and candidate is entirely responsible to maintain the confidentiality of their password. Furthermore, the employer and candidate are entirely responsible for any and all activities that occur under their login such as matching with employers and candidates, communications or interactions with the FindMe team.
The employer and candidate may change their password at any time by following instructions outlined in the User Guide. The employer may request FindMe to delete their profile at anytime during the pilot program period.
The employer and candidate agrees to immediately notify FindMe of any unauthorized use of a login, or any other breach of security.
No misrepresentations allowed
The employer and candidate agrees that it is a condition of participating in the Pilot Program, and utilising the FindMe platform, that they will not through any act or omission to (including but not limited to creating a profile on the FindMe) mislead or deceive others.
Privacy
Where used in this Statement, the terms “personal information”, and “Australian Privacy Principle(s)” have the meaning attributed to that term in the Privacy Act (Cth) 1988 (“Privacy Act”).
FindMe’s Privacy Statement has been created because we value our users and recognise their right to keep personal information private.
This Privacy Statement applies to any personal information that the employer and candidate choose to disclose to FindMe through the use of any products on the FindMe web application, including but not limited to, becoming a registered user, creating a Profile and submitting applications or viewing candidates.
IP Addresses
FindMe’s web servers gather the employer and candidate IP address to assist with the diagnosis of problems or support issues with our services, and to monitor the use of the FindMe web application.
Cookies & Applets
FindMe uses cookies and applets to provide the employer and candidate with a better browsing experience. These cookies and applets collect non-personal information such as preferences and click activity for measurement and for features such as remembering your details for ‘Auto Login’.
Users who do not wish to have cookies active whilst they browse can “opt out” by modifying the privacy options in their browser. However, doing so will prevent access to some areas of the FindMe platform, and limit the use of some of the functions.
Collecting information on Candidates
As part of registering with FindMe, we collect personal information about the employer and candidate in order for them to take full advantage of FindMe’s functionalities. To do this it will be necessary for the employer and candidate to provide information pertaining to their desired vocation, skill sets, pay rates, location, and languages spoken.
Other information FindMe may collect
FindMe may also collect and use information about an employer or candidate’s needs, characteristics and priorities by collecting and analysing data about how they use, or interact with the platform. FindMe may use this information for the purposes set out in this Privacy Statement, including without limitation to better tailor FindMe’s offerings to their needs and to provide more targeted services.
Registration
Becoming a Registered User allows the employer and candidate to take advantage FindMe’s functionalities offered. To become a Registered User an employer or candidate will need to submit the following personal information: your name, address, mobile phone number, email address and a password. The information provided by the employer and candidate when they register will be used to create a FindMe candidate profile. The employer or candidate may access and update their information at any time in the ‘Profile’ section of ‘Menu’, or as outlined in the User Guide.
FindMe will use this information in order to customise the service we provide to the employer and candidate. By undertaking the registration process the employer and candidate consents to FindMe contacting you via phone, SMS or email confirm your registration has been successful.
Employer & Job Profile
The employer and candidate profile will be used by FindMe to match to a job vacancy within the FindMe platform.
When FindMe determines that the information contained in the candidate profile makes them a suitable candidate for a position advertised on FindMe, either all or part of the candidate profile will be released to the relevant Employer who may contact the Candidate directly.
Storage & Security of Personal Information
FindMe takes all reasonable steps to ensure the security of our system and to protect the employer and candidate information from misuse, interference, and loss as well as unauthorised access, modification or disclosure. FindMe allows the employer and candidate to access their information at any time to keep it accurate and up to date. Any information which we hold for the employer and candidate is stored on secure servers that are protected in controlled facilities within Australia.
In addition, our employees and the contractors who provide services related to our information systems are obliged to respect the confidentiality and privacy of any personal information held by FindMe.
The employer and candidate can also play an important role in keeping their personal information secure, by maintaining the confidentiality of any password and registration profiles on the FindMe platform. Please notify FindMe immediately if there is any unauthorised use of an account by any other Internet user, or any other breach of security.
Feedback and Complaints about privacy and platform
FindMe welcomes ideas and feedback about all aspects of the platform. FindMe stores feedback that users send to us. This feedback may be used to administer and refine the service we provide and may be shared with FindMe’s partners either in aggregate form or with specific identifying characteristics removed.
If the employer or candidate has any complaints about FindMe’s dealings with personal information including any breaches by us of any Australian Privacy Principles or any questions regarding this Privacy Statement you are able to submit that complaint or query by contacting us at contactus@findmeapp.net.
Any complaints received by us will be referred for prompt investigation by our compliance team and a written response will be provided to you within 14 days.
